Terms of Service

1. Acceptance of Terms

By accessing or using CreatorPilot ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is operated by CreatorPilot ("we," "us," or "our").

2. Description of Service

CreatorPilot is a platform that enables Instagram Business and Creator account holders to set up automated direct message (DM) responses triggered by specific keywords in comments on their posts. The Service uses official Meta APIs to deliver messages on your behalf.

3. Eligibility

  • You must be at least 18 years old
  • You must have an Instagram Business or Creator account
  • You must have the authority to grant the permissions requested during account connection
  • You must comply with Instagram's Terms of Use and Community Guidelines

4. Account Registration

You create an account by connecting your Instagram account via Meta's OAuth flow. You are responsible for maintaining the security of your connected account. You agree to notify us immediately of any unauthorized access.

5. Acceptable Use

You agree not to use the Service to:

  • Send spam, unsolicited messages, or deceptive content
  • Violate Instagram's Terms of Use, Community Guidelines, or Meta Platform Policies
  • Send messages containing illegal, harmful, threatening, abusive, or harassing content
  • Impersonate another person or entity
  • Attempt to circumvent rate limits or API restrictions imposed by Meta
  • Use the Service for any purpose that violates applicable laws or regulations
  • Resell, sublicense, or redistribute access to the Service without authorization

We reserve the right to suspend or terminate accounts that violate these terms without notice.

6. Instagram API and Meta Compliance

The Service operates through official Meta APIs. Your use of the Service is also subject to Meta's Platform Terms and Developer Policies. You acknowledge that:

  • Meta may change, limit, or revoke API access at any time
  • Message delivery depends on Meta's API availability and rate limits
  • We are not responsible for changes to Meta's platform that affect Service functionality

7. Message Content

You are solely responsible for the content of messages sent through the Service. CreatorPilot does not review or approve messages before they are sent. You represent that your messages comply with all applicable laws, including CAN-SPAM, GDPR, and local regulations.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control (including Meta API outages). We are not liable for any losses resulting from service downtime.

9. Pricing and Payment

CreatorPilot is currently offered at no charge during Early Access while we build with founding users. We may introduce paid plans in the future, and if we do, we will provide advance notice before any pricing changes take effect.

10. Intellectual Property

The Service, including its design, code, and branding, is owned by CreatorPilot. You retain ownership of the content you create (message templates, campaign configurations). By using the Service, you grant us a limited license to process your content solely to deliver the Service.

11. Limitation of Liability

To the maximum extent permitted by law, CreatorPilot shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that messages will always be delivered successfully, as delivery depends on Meta's API.

13. Termination

  • You may terminate your account at any time by disconnecting your Instagram account and contacting us
  • We may suspend or terminate your access for violations of these terms
  • Upon termination, your data will be deleted in accordance with our Privacy Policy

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via the dashboard or email. Continued use of the Service after changes take effect constitutes acceptance of the new terms.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions.
